Terms of service

These terms apply to business customers using AshOS Customs. AshOS Customs is operated by Ashley Brown, sole trader, of 21 Hunts Mill, Crispin Place, Wallingford, OX10 0DR, United Kingdom. Contact: ashley.brown88@hotmail.co.uk.

Business-to-business service

The service is intended for businesses and people acting for business purposes. It is not currently offered as a consumer service.

What we provide

AshOS Customs provides commercial-invoice preparation and supporting customs-information review. The service may use software-assisted checks and each launch-phase completed document receives a specialist review before delivery.

Your responsibilities

You are responsible for providing accurate, complete and lawful source information and for checking the final document before using it. You remain responsible as exporter for shipment details including product identity, quantity, value, origin, classification, weights, consignee/importer information and any licences, restrictions or declarations that apply.

Customs decisions

AshOS Customs does not act as a customs authority or guarantee acceptance, clearance, duty treatment, delivery times or a particular decision by a carrier, broker or authority. We may flag information for review, but you must approve the final information used for your shipment.

Scope

During launch we do not accept Dangerous Goods, food, pharmaceuticals or controlled chemicals. We may decline work that is outside our supported scope, incomplete, unusually complex or unsuitable for the service.

Pricing and payment

For new customers, one complimentary commercial invoice per business is available, subject to review and acceptance. Subsequent completed commercial invoices are £12.99 each unless another price is agreed before work begins. Repeated free submissions from the same business may be declined. We will not charge for work without making the applicable price clear.

Corrections

If you identify an error in a document we prepared, contact us promptly. We will review the issue and, where the error arose from our preparation rather than incorrect or incomplete source information, we will use reasonable efforts to correct the document.

Liability

Nothing in these terms excludes liability that cannot legally be excluded. Subject to that, AshOS Customs is not responsible for indirect or consequential loss, loss caused by inaccurate or incomplete information supplied to us, or decisions and delays of carriers, brokers or authorities. For a paid job, our aggregate liability arising from that job will not exceed the amount paid for the affected service, except where the law does not allow that limitation.

Data and confidentiality

We handle personal information as described in our Privacy notice. We will use customer documents and shipment information for providing and administering the service and will not sell them as customer data.

Intellectual property

The AshOS Customs website, branding and service materials remain our intellectual property. You may use completed documents supplied to you for the shipment and your normal business, accounting and compliance purposes.

Governing law

These terms and any non-contractual dispute arising from the service are governed by the law of England and Wales, and the courts of England and Wales will have jurisdiction, subject to any mandatory rule that applies otherwise.
